These Terms of Use govern your access to and use of the Jamtable platform and website. By using our services you agree to these terms.

You are responsible for all activities that occur under your account, including actions taken by employees or contractors you authorise.

All content, software, systems, designs, trademarks, and materials provided by Jamtable are the property of Jamtable Pty Ltd or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for its intended purpose. You must not copy, modify, distribute, sell, sublicense, or create derivative works from any Jamtable materials without our prior written consent.

You retain ownership of all data you import or create within the platform (your dealership records, customer data, inventory). You grant Jamtable a limited licence to process that data solely to provide the platform services to you.

You are responsible for ensuring you have the right to upload and process any data you provide to the platform, including compliance with applicable privacy laws in relation to your customers' personal information.

8. Third-party integrations

The platform may connect to third-party services at your direction (payment gateways, supplier catalogues, delivery providers). Your use of those services is subject to their own terms and conditions. Jamtable is not responsible for the performance or availability of third-party services.

9. Service availability

We aim to provide a reliable and available service but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance from time to time and will endeavour to provide advance notice where practicable.

10. Fees and payment

Your use of the platform may be subject to subscription fees as agreed in your service agreement. We reserve the right to update pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

11. Limitation of liability

To the maximum extent permitted by law, Jamtable is not liable for any indirect, incidental, special, consequential, or punitive loss arising from your use of or inability to use the platform, including loss of data, revenue, or profits.

Our total liability to you in connection with these terms or the platform is limited to the fees you have paid to us in the 12 months preceding the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Australian law.

12. Indemnity

You agree to indemnify and hold harmless Jamtable, its directors, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your breach of these terms, or your violation of any applicable law.

13. Termination

We may suspend or terminate your access to the platform at any time if you breach these terms or if we reasonably believe your use poses a security or legal risk. You may cancel your account at any time in accordance with your service agreement.

On termination, provisions that by their nature should survive (including intellectual property, limitation of liability, and governing law) will continue to apply.

14. Governing law

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising under or in connection with these terms.
